Abstract
Rights and freedoms are among the most important topics raised at the global, regional and local levels. Today, a state's civil, cultural and civilizational progress is measured by its respect for human rights, including the right to travel and movement. Therefore, this study will focus on this right according to successive Iraqi constitutions and the laws emanating from them, starting with the 1925 Constitution, passing through the constitutions of 1958, 1963, 1964, 1968, 1970, the 1990 draft constitution, and ending with the 2005 Constitution. There is a set of Iraqi laws that constitute an obstacle to citizens' enjoyment of the freedom of travel stipulated in Article 44 of the 2005 Constitution of the Republic of Iraq. It was necessary to have legislation that is consistent with the new direction of the new constitutional phase that followed the 1970 Constitution and to reap the fruits of this new phase.
