التسجيلات الصوتية وأثرها على الأدلة الجنائية (دراسة مقارنة)
Abstract
The tremendous advancements of the information revolution have had a significant impact on the admissibility of evidence obtained through electronic means. A major shift has occurred in the types of evidence legally acceptable, thanks to the technological developments in this area. While criminals have clearly evolved their methods of committing crimes, to the point that traditional methods of proof are sometimes insufficient to address this new type of crime, it has become essential to develop new methods of evidence. Today, judicial authorities are required to deal with innovative and sophisticated forms of evidence in criminal proceedings, such as audio recordings. These recordings are considered a modern form of evidence and are often the most appropriate means of proving crimes committed electronically. They are the product of technical and scientific processes used by perpetrators to commit these crimes, which has led the judiciary to question whether such evidence truly reflects the truth. It is worth noting that the impact of technological advancements extends beyond the content of the evidence itself, encompassing the procedures used to obtain it.
