Abstract
Tribal customs always represent an essential pillar in supporting the state and the law and filling the void in the event of a defect in the application of the law, for many reasons, for example, the weakness of the state, such as its subjection to occupation by another state, as happened in Iraq after 2003 and the collapse of the state system and the application of the law, because The fall of the previous regime and the formation of a new one. During this period, the application of the law was weak in many joints, which helped with the emergence of tribal customs on the way to implementation.
