Abstract
Midwifery is a sacred human, moral, and scientific profession, which has its permanent importance and creates a relationship between the midwife and the pregnant woman. It is human in nature and legal. The relationship between the midwife and the pregnant woman becomes clear when the latter turns to a midwife to obtain her medical services, as the midwife takes care of the pregnant woman and her fetus in exchange for a fee that the pregnant woman is obligated to pay the midwife, and while the midwife takes care of the pregnant woman or gives birth naturally, the pregnant woman or her fetus may be exposed to harm that necessitates the responsibility of the civil midwife. The pregnant woman has the right to file her lawsuit against the midwife directly in accordance with the provisions of contractual or default liability, depending on the state of the medical contract or not, and the bearer may file her lawsuit against the hospital in which the midwife performs her work if the medical contract is concluded between the pregnant woman and the hospital.
