Abstract
Every state has a specific criminal policy that it sets in its punitive laws to limit criminal phenomena in society. This criminal policy must be consistent with the criminal ideology that the constitutional legislator lays down in the state’s constitution and consistent with international obligations. The ordinary legislator cannot enact laws that would It contradicts the criminal policy and the criminal philosophy whose general boundaries are drawn by the constitutional legislator, and this could constitute a breach of one or more of the rules and principles of international law.
