Abstract
In the topic of the research we dealt with judicial oversight of decisions to terminate the service of a public employee in Iraq according to criminal cases and that the termination case for penal reasons (disciplinary) is the authority of the administration is restricted according to the legal texts. Termination The discipline law is the basis for the organization of the legal relationship and no special laws have been singled out that regulate cases of termination of the employment association. Rather, its provisions have been organized in accordance with the laws that regulate cases of termination of the public employee’s service and the supervision of the administrative judiciary as a basis for ensuring the rights of the public employee through judicial appeal for the purpose of obtaining his right legally, and not taking this into account. It is considered a breach of the legal guarantees of the public employee and the administration, and the decision of the administration is subject to the authority of law and judicial oversight, and the reasons for choosing this topic are because of the importance of the public position of both the public employee and the administration and the organization of the continuation of the public facility for the purpose of satisfying the public needs and achieving the public interest in addition to the material and moral harm to the public employee in terms of livelihood For him and his family.
