Abstract
This research, tagged B (the penalty of dismissal and its impact on the job bond is a comparative study), deals with an important topic of the public service and related to one of the most severe penalties affecting the employee’s career which was mentioned and organizing cases imposed by successful Iraqi disciplinary laws, by adopting the method of comparison with the law Al-Masry’s approach to gain knowledge of the effect of imposing it on the functional bond in the two systems subject to comparison. Where we divided the study into three studies, the first section included the concept of disciplinary punishment in general and briefly touched upon the most important principles governing its imposition on the public employee. Knowing what it is and the mechanism of its regulation and the cases of its imposition in the Iraqi and Egyptian laws, in addition to distinguishing it from other cases of exclusion from the position, which take place in the two systems without going through the disciplinary method and its approved procedures stipulated in the laws of public employment or the laws of public discipline in Iraq, then we concluded our plan with a final topic discussing the impact The consequence of imposing a disciplinary dismissal penalty in Iraqi law, which is defined by a specific period, has two upper and lower And to make it of a temporary nature, and consequently, imposing it does not sever the job link permanently and permanently, unlike the situation regulated in the Egyptian legislation, in which the disciplinary dismissal penalty has been made to have a definite effect on the employee's relationship with management limits completely.
